On June 16, 2025, the court determined that Officer Samson Talam would be held at Lang’ata Police Station while awaiting a decision on whether the Independent Policing Oversight Authority (IPOA) would receive an extension of 21 days to complete their investigations.
The IPOA justified their request by emphasizing the need for additional time to gather crucial evidence and expressed concerns regarding the safety of the accused amid rising public outrage. In contrast, the defense team, led by attorney Danstan Omari, opposed the IPOA’s motion, arguing that the request lacked sufficient justification and that Talam should be granted cash bail.
They pointed out that Talam had been cooperative throughout the investigation, voluntarily presenting himself at the Directorate of Criminal Investigations (DCI) headquarters, and underscored his presumption of innocence despite public opinion. The defense further noted that Talam is not a flight risk, as he has a permanent residence in Eldoret, and requested a cash bail of seven thousand shillings, a position supported by fellow attorney Cliff Ombeta, who advocated for a free bond.
The prosecution, however, raised concerns that Talam might influence other witnesses, yet failed to identify any specific individuals, implying that he was not acquainted with them and thus could not interfere. With a career spanning 29 years, Talam, a father and husband, expressed his condolences to the affected family and assured the court of his willingness to comply with any conditions set, including refraining from entering Nairobi or the Central Police Station if released on bail.
He maintained his innocence and showed no apprehension regarding the ongoing investigation. The state’s legal representative, Lawyer Owiti, indicated that should the investigations conclude before the 21-day period, they would return to court with confirmation from Mr. Abdirahaman Jibril, affirming Talam’s innocence. The court’s ruling is scheduled for June 18, 2025, at 2 PM, during which Officer Talam will continue to be held at Lang’ata Police Station.
